Payment Terms Playster

The Site and the Application are, offered to you by Playster Corporation (“Playster”, “we”, “us”, or “our”) These Payment Terms (the “Payment Terms”) set forth an agreement between you and Playster with respect to the subscription services and other paid services made available by Playster on or through the Playster Services. Playster’s website is located at including the Playster mobile application (the “Application”) (together with the Site and the Application, the “Services”). These Payment Terms supplement the Terms and Conditions governing your use of the Playster Services (the “Terms and Conditions”), which are incorporated here by reference. Any capitalized terms used in these Payment Terms and not defined here will have the meanings set forth in the Terms and Conditions.

By using any part of the Services, or by creating a user account, you signify your acceptance of these Payment Terms. Playster may amend these terms from time to time in our sole discretion and without notice to you. When we make changes that we consider significant, we will inform you by an appropriate means of electronic communication.

You may only open a Playster account and/or use the Services if your acceptance of these Payment Terms is not prohibited by applicable law. As noted in the Terms and Conditions, you must be 18 years of age or older in order to use the Services. If you are under age 18, you may not use the Services under any circumstances or for any reason. By opening an account, downloading the Application, and/or otherwise using the Services, you represent that you are at least 18 years old.

If you do not agree to these Payment Terms, you may not subscribe to the Services or otherwise obtain paid services (including access to the library of digital Content) made available by Playster. You should review these Payment Terms each time you subscribe for, order and/or purchase any subscription or other paid services offered by Playster. If we make significant amendments to these Payment Terms, we will inform you by an appropriate means of communication. You will be deemed to have accepted these Payment Terms, as amended, if you continue to use the Services after we inform you.

Paid services

Certain of our Services (including access to our library of digital Content) may be subject to payments now or in the future (the “Paid Services”).Please note that any payment terms presented to you by us in the process of using or signing up for Playster Paid Services are deemed part of this Agreement.

Reaffirmation of authorization

If you do not cancel your account, in accordance with our Cancellation Policy as defined herein, your non-termination or continued use of a Paid Service reaffirms that we are authorized to charge your Payment Method (defined below) the applicable subscription price for that Paid Service. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to receive payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially selected to use the Paid Service.

Memberships and other promotions

You may be required to provide an applicable billing payment method to register for a free trial offer to the subscription service provided on or through the Services. The length of any free trial offer may vary and will be indicated at the time you register. There is a limit of one membership offer per payment method provided. Once you become a member of the service and provide Playster with your billing payment method, you authorize Playster to a pre-authorization in the form of a temporary USD $1 hold in order to validate the provided Payment method. This is not a charge and is usually returned to your balance within 72 hours. If you complete the membership and continue the subscription service, you will begin to be charged for the full subscription price for the Paid Service. It is possible that some financial institutions may perceive these requested amounts as actual pending charges. These are not actual charges, and you agree that Playster will not be responsible for any results, such as an overdraft fee, that may occur to your account with a financial institution as a result of such authorizations.

Any free trial or other promotion that provides access to a Paid Service must be used within the specified membership period. You must stop using a Paid Service and cancel your Subscription before the end of the free trial period in order to avoid being charged for that Paid Service. If you cancel prior to the end of the free trial period and are inadvertently charged for a Paid Service, please contact us at support@playster.com.

Your Playster subscription starts with a free trial offer, and continues until canceled. The membership lasts for the period specified during sign-up. If you cancel your subscription during the initial free trial period, you will not be charged. By starting your free trial, you authorize Playster to continue your month-to-month subscription (and to charge you at our then-current monthly rate) automatically after the conclusion of the initial free trial. Subscription fees will be charged monthly to the payment method provided until your subscription is canceled. No refunds or credits will be provided for partial months, and the subscription fee is charged at the beginning of the monthly period and the first day following the expiration of your membership will be your anniversary date for billing purposes.

Your account

To use Playster – as a paid subscriber or as part of an unpaid membership run -- you will need to create an account and provide certain registration information. As per our Terms of Service, you acknowledge that you are responsible for keeping your account and password secure, with carefully restricted access. You agree to accept responsibility for all purchases and other activities that occur under your account. Playster reserves the right to deny or cancel orders, and Playster may, in its sole discretion, terminate or suspend accounts. In the event that Playster terminates your account due to an actual or suspected violation of the Terms of Service or Payment Terms, products and services purchased in accordance with these Payment Terms or Terms of Service may be forfeited without any refund.

Payment methods

Playster accepts various forms of payment, as set forth on the Playster Site from time to time. The terms of your payment will be based on your Payment Method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen Payment Method. By subscribing to Playster or submitting an order for other paid services offered through the Services, you authorize Playster, or its designated payment processor, to charge the account you specify for the purchase amount. If we, through the Payment Processor, do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand. All payments are to be made in the currency designated by us. You are solely responsible for any and all fees charged to your Payment Method by the issuer, bank or financial institution including, but not limited to, monthly package fees, overdraft, insufficient funds and over the credit limit fees.

Billing

We use a third-party payment processor (the “Payment Processor”) to bill you through a payment account linked to your Account on the Services (your “Billing Account”) for use of the Paid Services. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to this Agreement. We are not responsible for any error by the Payment Processor. By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Services in accordance with the applicable payment terms and you authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that it makes even if it has already requested or received payment.

Recurring billing

By subscribing to Paid Services, you authorize Playster or its payment processor to charge the applicable recurring subscription fees to your designated billing payment method unless and until you cancel your subscription. When you initially subscribe to the Paid Services, you will be charged immediately for the initial period of the subscription at the then-current fee. Some of the Paid Services may consist of an initial period, for which there is a one-time charge, followed by recurring period charges as specified on the Services. By choosing a recurring payment plan, you acknowledge that such Services have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. All fees paid and charges made prior to cancelling your subscription are non-refundable, including advance charge(s) or payment for a subscription term during which you cancel your subscription. Cancellation of your subscription does not relieve you of any obligations to pay accrued charges.

WE MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY FEES) WITHOUT OBTAINING ANY FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE (RECEIPT OF WHICH IS CONFIRMED BY US) THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD. SUCH NOTICE WILL NOT AFFECT CHARGES SUBMITTED BEFORE WE REASONABLY COULD ACT. TO TERMINATE YOUR AUTHORIZATION OR CHANGE YOUR PAYMENT METHOD, GO TO YOUR ACCOUNT OR CALL OUR CUSTOMER SERVICE.

Current information requirement

YOU MUST PROVIDE CURRENT, COMPLETE AND ACCURATE INFORMATION FOR YOUR BILLING ACCOUNT. YOU MUST PROMPTLY UPDATE ALL INFORMATION TO KEEP YOUR BILLING ACCOUNT CURRENT, COMPLETE AND ACCURATE (SUCH AS A CHANGE IN BILLING ADDRESS, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE), AND YOU MUST PROMPTLY NOTIFY US IF YOUR PAYMENT METHOD IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USER NAME OR PASSWORD. CHANGES TO SUCH INFORMATION CAN BE MADE ON “MY ACCOUNT” PAGE OR BY CALLING CUSTOMER SERVICE. IF YOU FAIL TO PROVIDE ANY OF THE FOREGOING INFORMATION, YOU AGREE THAT WE MAY CONTINUE CHARGING YOU FOR ANY USE OF PAID SERVICES UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE TERMINATED YOUR PAID SERVICES AS SET FORTH ABOVE.

Auto-renewal for subscription services

Subscription Services you have signed up for will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected starting from the anniversary date corresponding to the first day following the end of your membership period, at the then-current non-promotional rate. For example, if your membership period for the Services expires June 17 and your subscription begins on June 18 your Payment Method will be charged on July 18 for the next monthly period unless you cancel prior to the anniversary date. To change or resign your Subscription Services at any time, simply call our toll free number 1-844-825-6276. If you terminate a Subscription Service, you may use your subscription until the end of your then-current term; your subscription will not be renewed after your then-current term expires. However, you won't be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

Canceling paid subscriptions

To cancel an ongoing, paid subscription, please call our call center 1-844-825-6276. Once you have cancelled your subscription, Playster will stop billing you until and unless you re-subscribe under your account or any other. Any and all fees paid and charges made prior to cancellation or termination of your account are generally non-refundable. Refunds will only be issued in accordance with Playster Refund Policy.

Refund policy

If you have been unable to enjoy Playster, we’ll be happy to refund you payments made for the time that you’ve been unable to use the Services.

Playster may, in its sole discretion, issue refunds in the following circumstances:

  • Technical issues - You’ve been unable to use Playster because of technical faults with the service itself;
  • Payment error - You were charged in error;
  • Fraud - it has been determined that your account has been the subject of fraud;
  • Unexpected or defective content - it has been determined that the content Playster provided through its Paid Service was inconsistent with what was provided in your Free Trial Period.

Playster does not offer refunds where:

  • You forgot to cancel your membership before a payment deadline or did not complete the Cancellation procedure;
  • You were unable to log into your Playster account to cancel your membership due to incorrect personal information;
  • Charges related to add-ons you agreed to pay for during the sign-up process;
  • Any charges that were applied to your credit card more than sixty (60) days prior you contacting us to contest the charges.

If you would like to request a refund, please contact us by submitting a support ticket on http://support.playster.com or using the Send an email button located on the same page. Please make sure to include your name, the email address used on sign up with Playster, a description of the issue and which charge(s) it relates to.

If Playster determines that you are eligible for a refund, the funds will be returned to the credit card that is currently assigned to your account.

Termination

If Playster determines, in its sole discretion, that you have violated these Payment Terms or the Terms and Conditions, we may suspend or terminate your access to all or any part of the Services at any time, with or without cause, with or without notice, effective immediately, which may result in the forfeiture and destruction of all information associated with your account. All fees paid hereunder are non-refundable, unless otherwise stated in the Refund Policy. Playster may also in its sole discretion, and at any time, modify or discontinue the subscription service, or any part thereof, with or without notice. You agree that Playster is not liable to you or any third-party for any interference with, or termination of, your access to the subscription service.

Mobile use

Playster is accessible on compatible mobile devices. An Internet enabled mobile device on which you have downloaded our applicable mobile Application is required. Standard data and usage charges instituted by your mobile carrier may apply (and are not included in any subscription fee paid to Playster) and you are solely responsible for such charges. Check with your mobile carrier regarding the terms of your individual data or usage plan.

Mobile use abroad

Playster does use some data, and an Internet connection is required to access and consume our Content. Most mobile carriers charge a fixed monthly price for data services, and the terms of your data plan may change when traveling abroad. Your carrier may charge additional fees or higher rates for data usage if you do not have an international plan. It is your responsibility to contact your mobile carrier before traveling to another country. Playster is not responsible for any additional charges incurred when you use the Services abroad.

These Payment Terms, together with the Terms of Service and Privacy Policy, constitute the entire agreement between you and Playster regarding your use of the Services. In the event of a conflict between these Payment Terms and the Terms and Conditions, these Payment Terms will govern.
